Promoting Gambling Offense in Ocean County
The offense of promoting gambling is set forth at N.J.S.A. 2C:37-2. This law renders an individual guilty of this charge if they knowingly:
- Accept or receive money or property in accordance with an agreement or conspiracy to engage in gambling activity; or
- Engage in conduct which materially aids gambling activity.
The term “gambling” is defined at N.J.S.A. 2C:37-1(b) as ““staking or risking something of value upon the outcome of a contest of chance or a future contingent event not under the actor’s control or influence, upon an agreement or understanding that he will receive something of value in the event of a certain outcome.

“Bookmaking” means accepting bets that wager on the outcome of future contingent events such a game of baseball, football, hockey, basketball, horse racing, etc. A “lottery” is a gambling scheme in which players pay or agree to pay for a wager or game of chance involving numbers or a combinations of numbers.
