- Made, or caused to be made, a false, fictitious, fraudulent, or misleading statement of material fact in, or omitted a material fact from, or caused a material fact to be omitted from, any record, bill, claim or any other document in writing, electronic or any other form; and
- Acted knowingly.
In determining whether these elements have been satisfied, 2C:21-4.6 establishes an inference that the accused read and reviewed the application, bill or other insurance or coverage document if they signed or initiated an application.
