Theft Charge in Ocean County

At one point in time, there were over fifty (50) varieties of theft set forth under NJ Law. These violations were, however, consolidated into a much smaller group which are now set forth in our criminal code. The lawyers on our staff defend all theft charges, including:

Under N.J.S.A. 2C: 20-2, the general grading and penalties for theft offenses are:

  • (1) It is a second degree crime to commit a theft of property with a value of $75,000 or more resulting in 5-10 years in prison and a fine of up to $150,000;
  • (2) It is a third degree crime to commit a theft of at least $500 but less than $75,000 resulting in up to 5 years in prison and a maximum fine of $15,000;
  • (3) It is a fourth degree crime to commit a theft of at least $200 but less than $500 resulting in up to 18 months in prison and a fine that can reach $10,000; and
  • (4) It is a disorderly persons offense to commit a theft of property with a value of less than $200 resulting in a fine of up to $1,000 and the possibility of up to 6 months in jail.
