Former Driving While Intoxicated Prosecutors in More Than 15 Municipalities in Ocean County
Whether in Seaside Heights, Toms River, Jackson, Stafford or another municipal court in Ocean County, N.J.S.A. 39:4-50.14 makes it illegal for a person under 21 to operate a motor vehicle with any alcohol in their system. This means that any amount of alcohol, even a BAC reading as low as 0.01%, can result in an underage DWI violation under N.J.S.A. 39:4-50.14. This BAC level is a far lower than the 0.08% required for a regular DWI charge and reflects what is basically a zero tolerance under the law for those who operate a motor vehicle after illegally consuming any quantity of alcohol.
