All assault offenses filed in Point Pleasant Beach arise out of N.J.S.A. 2C:12-1. Simple assault is set forth in subsection (a) and aggravated assault is contained in subsection (b). A simple assault is committed if someone: (1) attempts or intentionally causes bodily injury to another; (2) negligently causes bodily injury with a deadly weapon; or (3) puts someone in fear of serious injury by engaging in physical menace. A simple assault is enhanced to an aggravated assault if the victim is a police officer, teacher, EMT or another individual granted heightened protection by law. An aggravated assault also results where the victim sustains serious bodily injury, significant bodily injury or any number of other circumstances apply.

Simple assault is a disorderly persons offense that is handled in Point Pleasant Municipal Court and results in a fine of up to $1,000 and up to six months in prison. Higher grades of aggravated assault are referred to the Superior Court in Toms River where jurisdiction rests. A fourth degree crime for aggravated assault in this court carries a $10,000 fine and up to 18 months in prison. Third degree aggravated assault results in a sentence that includes a maximum fine of $15,000 and up to 5 years of incarceration.
