Charged With Drug Possession in Manchester Township
Almost all drug possession cases in Manchester Township arise out of N.J.S.A. 2C:35-10. This law makes it illegal to actually or constructively possess any form of cds without obtaining a valid prescription. The severity of a violation of this law depends on the type and quantity of drugs involved. Personal possession of heroin, cocaine and other Schedule I, II, III & IV forms of cds results in a third degree crime. It is a fourth degree crime to possess more than 50 grams of marijuana or more than five grams of hashish. Possession of 50 grams or less of marijuana in Manchester is a disorderly persons offense.
Arrested for Distributing Drugs in Manchester
Distribution of drugs in Manchester results in a violation of N.J.S.A. 2C:35-5. When the conduct is in a school zone, an additional offense applies under N.J.S.A. 2C:35-7. The same is true if someone is selling, distributing or possessing drugs with intent to distribute in a public park or house project zone except that the law which applies is N.J.S.A. 2C:35-7.1. A conviction for distribution or possession with intent to distribute cds results in a third degree, second degree or first degree crime depending on the quantity being sold. The only exception is where an ounce or less of marijuana is concerned in which case distributing/selling is a fourth degree crime.Manchester NJ Drug Possession Defense Lawyer
