The New Jersey Disorderly Conduct Law is contained at N.J.S.A. 2C:33-2. This statute makes it a disorderly persons offense to engage in improper behavior or to use offensive language in public. Behavior is improper if it is for the purpose of causing “public inconvenience, annoyance or alarm, or recklessly creating a risk thereof” and involves either: (1) fighting, threatening, violent or tumultuous behavior; or (2) creates a hazardous or physically dangerous condition. Offensive language results in disorderly conduct when it is uttered for the purpose of offending someone or is done recklessly and is “unreasonably loud and offensively coarse or abusive language” given those who are present. The penalties that may be imposed by the judge of the Jackson Municipal Court include a fine of up to $1,000 and a period of incarceration at the county jail that can reach 6 months.
