The resisting arrest law is contained at N.J.S.A. 2C:29-2. An individual is exposed to a disorderly persons offense for resisting arrest, a charge falling under municipal court jurisdiction, if they “purposely prevents or attempts to prevent a law enforcement officer from effecting an arrest”. The violation is enhanced to a fourth degree crime, the lowest felony grade, when flight is used. This should be distinguished from eluding which is use of an automobile to resist.
