Charged With Resisting Arrest in Brick New Jersey

The resisting arrest law is contained at N.J.S.A. 2C:29-2. An individual is exposed to a disorderly persons offense for resisting arrest, a charge falling under municipal court jurisdiction, if they “purposely prevents or attempts to prevent a law enforcement officer from effecting an arrest”. The violation is enhanced to a fourth degree crime, the lowest felony grade, when flight is used. This should be distinguished from eluding which is use of an automobile to resist. Resisting arrest is enhanced to a third degree crime if threats or physical force is used to resist or the accused creates a substantial risk of injury. One of the most important things you need to know about this offense is that you have no right to resist an unlawful and/or unwarranted arrest. In other words, it is not a defense to a 2C:29-2 charge that you did nothing wrong in the first place.

A disorderly persons offense for resisting arrest results in up to a $1,000 fine and six months in jail. Fourth degree resisting arrest carries a $10,000 fine and up to eighteen months in state prison. The penalties for third degree resisting arrest include a $15,000 fine and up to 5 years of imprisonment.
