Aggravated Assault Offense in Brick Township

The NJ Aggravated Assault Law is contained at N.J.S.A. 2C:12-1(b). You may be convicted of this offense if you: (1) attempt to cause, purposely cause, or exercise extreme indifference to the value of life and cause a serious bodily injury; (2) attempt or intentionally cause bodily injury with a deadly weapon; (3) recklessly cause bodily injury with a deadly weapon; (4) point a firearm at another person; (5) commit a simple assault on a police officer, teacher, EMT, firemen, DYFS worker, member of the judiciary or another person set forth at 2C:12-1(b)(5); (6) cause significant bodily while eluding police; or (7) attempt to cause, intentionally cause or act with extreme indifference to the value of life and cause significant bodily injury.

An aggravated assault charge can be filed as a fourth degree, third degree or second degree crime depending which subsection of 2C:12-1(b) applies. Fourth degree aggravated assault results in a fine of up to $10,000 and up to 18 months in prison. Third degree aggravated assault carries maximum penalties that include a $15,000 fine and 5 years of imprisonment. Second degree aggravated assault triggers 5-10 years in prison and a fine that can reach $15,000.
