Driving Without Insurance in Ocean County
The violation known as driving without insurance is set forth at N.J.S.A. 39:6B-2. In order to convict you of this offense, the prosecutor in Jackson, Barnegat or another municipal court must establish several elements. He must establish, beyond reasonable doubt, that:
- A motor vehicle was operated on a public roadway in New Jersey;
- The car, truck or other vehicle was principally garaged in New Jersey;
- The defendant was the owner or operator of the vehicle; and
- There was no automobile or other liability insurance at the time of operation.
You will note that, unlike many criminal or traffic offenses, there is no requirement that a defendant have knowledge that the subject vehicle is uninsured.
Penalties for Driving Without Automobile Insurance
