Ignition Interlock Requirements in New Jersey
Offense | Requirement | Duration |
First Offense DWI or Refusal | If you refused or submitted a breath sample of at least.15%, you are required. Imposition of this requirement is discretionary where the BAC is below .15%. | Interlock must be installed for the duration of the suspension plus 6-12 months following restoration |
Second Offense DWI or Refusal | Mandatory | Period of suspension plus 1-3 years once privileges are restored. |
Third Offense DWI or Refusal | Mandatory | Same as second offense. |
Failure to Satisfy the Requirement
If you fail to comply with the ignition interlock requirement, a license will be reimposed. It is also possible for you to be ordered to return to court and face further punishment, including jail.
Individuals Who Do Not Operate a Vehicle
The obligation applies to any and all motor vehicles that you operate. In other words, you cannot operate a car or truck during the interlock period unless it is fitted with this ignition device. You do not need to install an ignition interlock if you are not driving but you also do not need to be restored if this is the case as New Jersey DMV issues identification only licenses.
