Toms River CDS Possession Offense
Most cds possession offenses in Toms River arise out of N.J.S.A. 2C:35-10. This law makes it unlawful to possess cds absent a valid prescription. Some drugs are illegal in any context because there is no valid medical use and heroin, cocaine, methamphetamine, LSD, MDMA (e.g. Molly, Ecstasy) are a few falling within this category. The same is the case with a fourth degree marijuana possession except that the maximum fine is $25,000. A disorderly persons offense for possession of cds/drugs results in a jail sentence that can reach 6 months and a fine of as much as $1,000.
