Toms River CDS Possession Offense

Most cds possession offenses in Toms River arise out of N.J.S.A. 2C:35-10. This law makes it unlawful to possess cds absent a valid prescription. The penalties for third degree possession of cds include up to 5 years in prison and a maximum fine of $35,000. A fourth degree crime for possessing Schedule V drugs carries a potential fine of $15,000 and up to 18 months in prison. The same is the case with a fourth degree marijuana possession except that the maximum fine is $25,000. A disorderly persons offense for possession of cds/drugs results in a jail sentence that can reach 6 months and a fine of as much as $1,000. All Toms River convictions for possessing cds also result in a driver’s license suspension of 6-24 months.
