Distributing any variety of cds (a.k.a. drugs) in Brick Township results in a felony crime that carries stiff penalties under N.J.S.A. 2C:35-7. It is a third degree crime to distribute or sell heroin, MDMA, methamphetamine and cocaine in a quantity of less than one-half ounce. It is a second degree crime to distribute at least one-half ounce but less than five ounces of these drugs. Distributing five or more ounces is a first degree crime. Distribution of LSD results in a first degree crime where the quantity sold is 100 milligrams or more and in a second degree crime where the amount of LSD distributed is less than 100 milligrams. The penalties for first degree drug distribution include a state prison term of 10-20 years. A second degree crime for distributing cds/drugs carries 5-10 years of incarceration. A third degree crime for selling or possession with intent to distribute results in a 3-5 year prison term. Fourth degree distribution can trigger up to 18 months in jail.
