Driving Without Insurance in Ocean County

The violation known as driving without insurance is set forth at N.J.S.A. 39:6B-2. In order to convict you of this offense, the prosecutor in Jackson, Barnegat or another municipal court must establish several elements. He must establish, beyond reasonable doubt, that:

  1. A motor vehicle was operated on a public roadway in New Jersey;
  2. The car, truck or other vehicle was principally garaged in New Jersey;
  3. The defendant was the owner or operator of the vehicle; and
  4. There was no automobile or other liability insurance at the time of operation.

You will note that, unlike many criminal or traffic offenses, there is no requirement that a defendant have knowledge that the subject vehicle is uninsured.

Penalties for Driving Without Automobile Insurance

The penalties that apply at the time of sentencing are severe under 39:6B-2. In fact, the period of suspension exceeds that for driving while intoxicated ("DWI"). The charge that follows sets forth the fines, community service, license suspension and jail for driving without insurance.

I'm 45 years old and this was my first time ever getting in trouble with the law. I was in need of a lawyer and after careful research, I called John F. Marshall Attorneys and was introduced to Abe Basch. Abe was professional, supportive and very thorough. I had three charges against me, one civil and two criminal. I was so scared and expressed that to Abe. The first day I had to go to court, I was an absolute nervous wreck but Abe prepped me and kept my anxiety levels down by going over the process of the courts thoroughly with me. He fought to get my charges dismissed and won all three cases (two court appearances). Abe is positive, confident and he ensured I felt the same way. I'd like to say thank you to Abe for working so diligently on my cases to get them dismissed. I feel like a weight has been lifted off my chest! I highly recommend Abe for any charges you may be faced with. Rose C.
