Arrested for Possessing Marijuana for Violating N.J.S.A. 2C:35-10

There are two varieties of marijuana possession that an individual may face under N.J.S.A. 2C:35-10. The first form is a fourth degree crime that results where an individual is convicted of possessing more than 50 grams of marijuana. If the quantity possessed does not exceed this threshold, possession is a disorderly persons offense. Anyone convicted of possession under 2C:35-10 also faces a 6 month revocation of their privilege to drive. The suspension period escalates to 2 years upon conviction for possession of CDS in a motor vehicle. Special enhancements apply when someone possesses marijuana in a school zone. “School zone” is defined as any location within 1,000 feet of school property. Possession of marijuana in a school zone results in an additional penalty of not less than 100 hours of community service unless a jail sentence is imposed.
